Welcome to LAVAYDO. In these Terms of Service, the words "we", "us" and "our" refer to LAVAYDO, a trading name of Berudo Group Spain S.L. We operate this website and online store, together with all related content, features, tools, products and services that make up your shopping experience (collectively, the "Services"). Our store runs on the Shopify platform, which provides the technology that allows us to offer the Services to you.
These Terms of Service, together with any policies referred to within them (the "Terms"), set out the rights and responsibilities that apply whenever you use the Services.
Please read these Terms carefully — they contain important information about your legal position, including disclaimers of warranty and limits on our liability.
By visiting, browsing or otherwise using the Services, you confirm that you accept these Terms and our Privacy Policy. If you do not agree with them, you should not use or access the Services.
1. Access and Your Account
By accepting these Terms, you confirm that you are at least 18 years old (or the age of majority in your country of residence). If you let a minor in your care use the Services on a device you own or control, you take responsibility for their use.
To shop with us — whether browsing the store or placing an order — you may be asked to share certain details such as your email address and your billing, payment and delivery information. You confirm that everything you provide is accurate, current and complete, and that you are entitled to provide it.
Keeping your login details secure is your responsibility, and you are accountable for any activity carried out under your account. You may not sell, transfer, assign or license your account to anyone else.
2. Our Products
We make every reasonable effort to represent our products and services accurately throughout the store. That said, colours and finishes can look different in real life depending on the screen, device and display settings you use to view them.
We cannot promise that the appearance or quality of any product or service you buy will match your personal expectations exactly, or look identical to the images shown online.
Product descriptions may be changed at any time, at our discretion and without prior notice. We may also withdraw any product, and may limit the quantities available to any individual, region or jurisdiction, on a case-by-case basis.
3. Orders
Placing an order constitutes an offer from you to purchase. We may accept or decline any order at our discretion, and your order is only confirmed once we have accepted it. Payment must be received and processed before acceptance. Please check your order carefully before submitting it, as we may be unable to change or cancel an order once it has been accepted. If we decline, amend or cancel an order, we will try to reach you using the email address, billing address or phone number you supplied at checkout.
Returns and exchanges are handled solely in line with our Refund Policy.
You confirm that anything you buy from us is for your own personal or household use, and not for commercial resale or export.
4. Pricing and Payment
Prices, discounts and promotions can change at any time without notice. The price that applies to your order is the one shown at the moment you place it, and it will be confirmed in your order confirmation email. Unless we state otherwise, displayed prices exclude taxes, delivery, handling and any customs or import charges.
Prices in our online store may differ from those offered elsewhere, including by third-party retailers. From time to time we may run promotions governed by their own separate terms; where those terms conflict with these Terms, the promotion terms take priority.
You agree to provide accurate, up-to-date purchase, payment and account details for every order, and to keep that information current — including your email and card details — so that we can process your transactions and contact you when needed.
You confirm that: (i) the payment details you give us are true, correct and complete; (ii) you are authorised to use the payment method; (iii) your payment provider will honour the charges; and (iv) you will pay the amounts due at the prices shown, including delivery and any applicable taxes.
5. Shipping and Delivery
Delivery timeframes are estimates only and are not guaranteed. We are not liable for delays caused by carriers, customs processing or any other circumstances beyond our control. Once your order is handed to the carrier, responsibility and risk for the goods pass to you.
6. Intellectual Property
The Services — including all trademarks, branding, text, graphics, images, product reviews, video, audio, and the way these are selected and arranged — belong to LAVAYDO, its affiliates or its licensors, and are protected by applicable Spanish, UK and international intellectual property laws.
These Terms allow you to use the Services for your own personal, non-commercial purposes only. Without our prior written permission, you may not copy, reproduce, distribute, modify, adapt, republish, download, store, transmit, or publicly display or perform any material from the Services. Nothing in these Terms grants you any licence or right under any trademark, copyright, patent or other intellectual property belonging to us, Shopify or any third party, except as expressly stated. Unauthorised use may breach intellectual property law. All rights we do not expressly grant are reserved.
The LAVAYDO name, logo and any related product names, designs and slogans are trademarks of LAVAYDO or its affiliates, and may not be used without our written consent. The Shopify name and logo are trademarks of Shopify. All other names and marks appearing on the Services belong to their respective owners.
7. Third-Party Tools
The Services may give you access to tools provided by third parties that we neither control nor monitor.
Such tools are made available "as is" and "as available", without any warranty, representation or endorsement of any kind, and we accept no liability arising from your use of them.
Any use of these optional third-party tools is entirely at your own risk, and you should make sure you are comfortable with the relevant provider's own terms before using them.
We may introduce new features or tools through the Services in future; these will also form part of the Services and be subject to these Terms.
8. Third-Party Links
The Services may include content from, or links to, websites operated by third parties, including embedded third-party functionality. We do not review or take responsibility for the content or accuracy of those third-party materials or sites. If you choose to leave our Services to visit them, you do so at your own risk.
We are not responsible for any loss or damage connected with your use of third-party websites or your purchase of any third-party products or services. Please read the relevant third party's policies before transacting with them, and direct any related queries or complaints to that third party.
9. Relationship with Shopify
LAVAYDO is powered by Shopify, which provides the technology behind the Services. However, every sale and purchase made in our store is made directly with LAVAYDO. By using the Services, you acknowledge that Shopify is not responsible for any aspect of the transactions between you and LAVAYDO, including any injury, damage or loss arising from the products or services you buy. You release Shopify and its affiliates from any claims, damages and liabilities relating to your purchases and dealings with LAVAYDO.
10. Privacy
Any personal information we collect through the Services is handled in accordance with our Privacy Policy, and some information may also fall under Shopify's Privacy Policy. By using the Services, you confirm that you have read these policies.
Because our store is hosted by Shopify, Shopify collects and processes information about how you access and use the Services in order to provide and improve them. Information you submit may be shared with Shopify and with partners who may be located in countries other than your own, so that the Services can be delivered to you. Our Privacy Policy explains in more detail how we, Shopify and our partners use your information.
11. Feedback and Submissions
If you send us ideas, suggestions, reviews, proposals or any other content ("Feedback"), you grant us a perpetual, worldwide, sub-licensable, royalty-free licence to use, reproduce, modify, publish, distribute and display that Feedback in any medium and for any purpose, including commercial use — for example, to run, improve and promote the Services.
You confirm that: (i) you own or hold all necessary rights to your Feedback; (ii) you have disclosed any compensation or incentive linked to it; and (iii) it complies with these Terms. We are not obliged to keep your Feedback confidential, to pay for it, or to respond to it.
We may (but are not required to) monitor, edit or remove any Feedback we consider unlawful, offensive, defamatory, obscene or otherwise objectionable, or that infringes anyone's rights or these Terms.
You agree that your Feedback will not infringe any third party's rights — including copyright, trademark, privacy or personality rights — and will not be unlawful, abusive or obscene, or contain viruses or malicious code. You may not misrepresent your identity or the origin of any Feedback. You are solely responsible for what you submit and for its accuracy, and we accept no liability for Feedback posted by you or any third party.
12. Errors and Inaccuracies
Occasionally the Services may contain typographical errors, inaccuracies or omissions relating to descriptions, pricing, promotions, delivery charges, transit times or availability. We may correct any such errors and change or update information — or cancel orders affected by inaccurate information — at any time without prior notice, including after you have placed your order.
13. Acceptable Use
You may use the Services only for lawful purposes. You agree not to use them, directly or indirectly: (a) for any unlawful or malicious purpose; (b) to breach any applicable laws or regulations; (c) to infringe our intellectual property rights or those of others; (d) to harass, abuse, defame, intimidate or harm any person; (e) to submit false or misleading information; (f) to use material that does not comply with these Terms; (g) to send spam, junk mail, chain letters or similar unsolicited material; (h) to impersonate any person or entity; or (i) to behave in any way that restricts others' use of the Services or could expose us, Shopify or other users to harm or liability.
You also agree not to: (a) upload viruses or malicious code; (b) copy, resell or exploit any part of the Services; (c) collect or track others' personal information; (d) spam, phish, pharm, spider, crawl or scrape; or (e) interfere with or circumvent the security of the Services or any related systems. We may suspend, disable or terminate your account at any time, without notice, if we believe you have breached these Terms.
14. Termination
We may end this agreement or withdraw your access to the Services (in whole or in part) at any time and at our discretion, without notice. You will remain responsible for any amounts owed up to the date of termination.
The following sections survive termination: Intellectual Property, Feedback and Submissions, Termination, Disclaimer of Warranties, Limitation of Liability, Indemnification, Severability, Waiver and Entire Agreement, Assignment, Governing Law, Privacy, and any other provisions that by their nature should continue.
15. Disclaimer of Warranties
The information provided through the Services is for general information only. We do not warrant that it is accurate, complete or useful, and any reliance you place on it is at your own risk. We disclaim responsibility for any reliance placed on such material by you or anyone else.
Except where we expressly state otherwise, the Services and all products offered through them are provided "as is" and "as available", without warranties or conditions of any kind, whether express or implied — including implied warranties of merchantability, satisfactory quality, fitness for a particular purpose, durability, title and non-infringement. We do not guarantee that your use of the Services will be uninterrupted, secure, timely or error-free. Some jurisdictions do not allow certain warranty exclusions, so parts of this disclaimer may not apply to you. Nothing in these Terms affects your mandatory statutory rights as a consumer.
16. Limitation of Liability
To the fullest extent permitted by law, neither LAVAYDO nor our partners, directors, officers, employees, affiliates, agents, contractors, service providers or licensors (nor those of Shopify and its affiliates) will be liable for any injury, loss or claim, or for any direct, indirect, incidental, punitive, special or consequential damages of any kind — including lost profits, lost revenue, lost data or replacement costs — arising from your use of the Services or any product bought through them, even where the possibility of such damages was known. Nothing in these Terms excludes or limits any liability that cannot be excluded or limited under applicable law, including your statutory consumer rights.
17. Indemnification
You agree to indemnify and hold harmless LAVAYDO, Shopify, and our respective affiliates, partners, officers, directors, employees, agents, contractors, licensors and service providers from any losses, damages, liabilities or claims (including reasonable legal fees) brought by any third party arising from: (1) your breach of these Terms or any documents they incorporate; (2) your breach of any law or any third party's rights; or (3) your access to or use of the Services.
We will notify you of any claim for which we seek indemnity, though a delay in doing so will not release you from your obligations unless it materially prejudices you. We may manage the defence and settlement of such a claim at your expense, but will not agree any settlement imposing non-monetary obligations on you without your consent (not to be unreasonably withheld). You agree to cooperate with the defence of such claims.
18. Severability
If any provision of these Terms is found to be unlawful, void or unenforceable, that provision will still be applied to the maximum extent permitted by law, and the unenforceable part will be treated as severed. This will not affect the validity or enforceability of the remaining provisions.
19. Waiver and Entire Agreement
If we do not exercise or enforce any right or provision of these Terms, that does not amount to a waiver of it.
These Terms, together with any policies or operating rules we post in connection with the Services, form the entire agreement between you and us regarding your use of the Services, and supersede any earlier agreements or communications, whether written or oral (including any prior versions of these Terms). Any ambiguity will not be interpreted against us as the drafting party.
20. Assignment
You may not transfer, assign or delegate these Terms or any of your rights or obligations under them without our prior written consent, and any attempt to do so is void. We may transfer, assign or delegate these Terms and our rights and obligations freely, without your consent or notice.
21. Governing Law
These Terms, and any separate agreements through which we provide the Services, are governed by the laws of Spain, where Berudo Group Spain S.L. is established, without regard to conflict-of-law principles. Nothing in this section removes the mandatory consumer protections you are entitled to under the law of your country of residence — if you are a consumer based in the United Kingdom, you continue to benefit from the protections of UK consumer law and may bring proceedings before the UK courts where the law allows.

Headings are included for convenience only and do not affect the interpretation of these Terms.
23. Changes to These Terms
The most current version of these Terms is always available on this page. We may update, change or replace any part of them at our discretion by posting the revised version here, and it is your responsibility to check back periodically. Where required by law, we will notify you of material changes, which take effect on the date stated in the notice. By continuing to use the Services after changes are posted, you accept the updated Terms.
